Can I honeymoon on the I-131 Advance Parole/Application for Travel Visa?

I am a US citizen and my Australian fiance is coming to the United States in July on a K-1 visa. We are planning on getting married in September of this year (2009). We will be filing the I-485 Adjustment of Status/I-765 Application for Employment Authorization applications soon after our marriage but I was wondering about filing the I-131 Advance Parole/Application for Travel concurrently with these. My fiance and I would like to go on a cruise for our honeymoon sometime this winter. The cruise would be traveling outside the United States. The I-131 form seems to stress that advance parole is only granted in emergency or drastic situations, so I was wondering if anyone knows if the USCIS considers a honeymoon a “legitimate” reason for needing to travel outside the US. Should we even bother applying or just wait until my fiance gets conditional residency?

Nothing is stopping you from filing form I-131 in order to receive an I-512. The advance authorization for parole (I-512 form) authorizes the Department of Homeland Security (DHS) to permit an alien to come to the U.S. and enter the country as a parolee. It does not “authorize” his or her departure.

Every parole authorization (form I-512) must be justified on a case-by-case basis. The justification for any parole under section 212(d)(5) of the Act must rest on either of two statutory provisions (or conceivably, both):

·Urgent humanitarian reasons or significant public benefit reasons.

If you feel that your honeymoon qualifies as either of these two justifications, you may have a strong argument for obtaining an advanced parole form. Approval of the I-131 results in the issuance of form I-512.

If she gets an I-512, she’ll be able to travel and come back without abandoning her I-485 application.
